TERMS OF SERVICE 
By purchasing services or products from PAWAII, you, the Customer, thereby agree to the following Terms of Service.

ELIGIBILITY
PAWAII will not accept Commissions or sell products to any persons under 18 years of age. 


Age verification will be required before payment is taken. Acceptable forms of identification are government issued, such as a driver's license or passport. If you are unable to supply any proof of age, PAWAII reserves the right to refuse services. 


If you are under 18 years age, your parent or guardian may approach us about purchasing services or products. 
If you don't meet these eligibility requirements or falsify documents, PAWAII reserves the right to cancel orders. 


Honesty and Kindness go a long way. PAWAII understands our Customers are people, just as much as we are, and we are willing to work with you. Please be professional and respectful when in correspondence with PAWAII. Excessive use of sexual, offensive, or foul language will not be tolerated. 
 

PAWAII reserves the right to refuse service to anyone.

COMMISSIONS
Commissions are custom orders. Commissions are not first come first serve. No verbal contracts and discussions about Commission details will be valid. All changes to Commissions and specifics must be written and agreed upon by both parties. 


PAWAII will not attempt to recreate any other artist's style or the styles of copyrighted franchises. 
By commissioning PAWAII, you acknowledge that each fursuit is a work of art that is completely unique. As such, Commission results will vary and are not guaranteed. PAWAII will use the information and visual references provided to produce each Commission, so it is the responsibility of the Customer to provide any and all pertinent details during the Quote Request process.

 

The Customer will be responsible for providing an accurate and usable DTD, or Duct Tape Dummy. A usable DTD will meet the following standards: will have been taped to the individual's wrist and ankle length (no shorter), will be smooth with no bunching and bulging in areas that are not reflective of the Customer's body, will be at least two layers thick of duct tape across the entirety of the DTD, will have been constructed while the Customer was maintaining proper posture (feet placed at shoulder length or slightly more outwards, with arms outstretched parallel to the ground), and have markings along the seams to indicate how the dummy will be reconstructed. If there is any confusion about how to make a DTD or our standards, please contact us before attempting to make one.    


Complete Artistic Freedom Commissions will require the Customer to provide a species and gender for PAWAII to create a completely new and unique character. All other details provided by the Customer about the Commission are considered suggestions only, and the Artist maintains the right to complete the Commission how they see fit. 


Limited Artistic Liberties Commissions, otherwise known as LAL Commissions, will require visual references and will also incorporate written instruction. The PAWAII Artist will use these instructions and references, provided in the Quote Request, to construct the Commission. The Artist reserves the right to correct any inconsistencies or improvise where there is not enough information provided. Work in Progress images may not be provided, this will be at the Artist's discretion. 

 
Strict Commissions require the Customer to provide a detailed and completely accurate Reference Sheet during the Quote Request process. Only Reference Sheets with no missing information or inconsistencies will be eligible for this style of Commission. The Customer will also be required to approve fur swatches, eyes, and head shape. 

 

Commission contracts become active when the Customer's down payment is processed and complete. Commission construction will begin once the Commission has been paid for in full.

By commissioning PAWAII, the Customer accepts that they own the rights, or have permission to use the design submitted. Please do not submit characters that you do not own, or copyrighted characters and designs you do not have the permission to use. 


In the case of stolen designs or content, the Customer will be responsible for all consequences and will not be eligible for refunds. PAWAII reserves the right to withhold product if the design is suspected to be stolen.


PAWAII will attempt to remedy bad situations, and weed out thieves, but the Customer will be responsible for any damages or legal action brought against themselves and/or PAWAII in result of their commissioning stolen material. PAWAII will not be responsible for said damages and legal fees.

EXTRA FUR
At the request of the Customer, PAWAII will purchase extra fur and store it for 2 years from the day the contract becomes active. This option will be considered an order separate from the Commission it accompanies. This option will place the Customer in a wait-list for "bodysuit-only" Commissions, and will be offered spots in the Queue before the general public. The Extra Fur MUST be used for the commissioning of a matching body suit for the previous Commission, and will not apply to any other unrelated designs. 


Once a new contract becomes active, the extra fur will be absorbed into the overall cost of the Commission and any extra fur will be owned and kept by PAWAII. 


If the Customer has not commissioned a bodysuit within 2 years, PAWAII will send the extra fur to the Customer and the Customer will be removed from the bodysuit-only wait-list. Extensions to this time limit may be available at PAWAII's discretion. 


The Customer will pay for the cost of the fur, shipping to the PAWAII studio, handling fees, and storage fees. The Customer will also pay shipping from the PAWAII studio preemptively, and PAWAII will hold this amount until a new Commission is active, or the customer decides to cancel the order. An additional amount will be requested from the Customer at the time the extra fur is shipped to them if the amount held by PAWAII is not sufficient to cover shipping costs.  PAWAII is not responsible for damage that occurs during shipping.

QUOTES
A quote is the estimated cost of a Commission based off of information the Customer provides. Quotes will be available during select times by submitting the current quote form, located under the "Request Quote" section of 'PawaiiFursuits.com'. Please allow 2-8 business days for your forms to be processed. If you do not hear back within this period of time, please feel free to contact us.


Quotes, once approved by the Artist, are only valid for 3 months. You will need a valid quote in order to commission PAWAII, so if yours has expired, please submit a new quote request.  


In order to submit a quote, the Customer must fill out the quote form in its entirety with accurate information. If any information is missing, incorrect, or inconsistent, the quote may be denied. 


A Reference Sheet may be required in order to obtain a quote. A Reference Sheet must be an ACCURATE 2-D illustration with flat colors that is acceptable for general audiences. If adult artwork is submitted, your form will be denied. 


If any information or the Reference Sheet provided is inaccurate and must be changed after the Commission has been accepted, additional charges may be incurred or the commission may be cancelled. If you cannot, or refuse, to pay penalties, PAWAII reserves the right to cancel the order.

COMPLETION DATES
PAWAII does not guarantee completion of projects by certain dates. It is highly recommended that you make your order at least 6 months before your desired completion date and make payments on your Commission as soon as possible. Any dates given for completion are estimates only and may change. 


For an additional fee, customers may request Rushes on projects. The request will be approved or denied at the artist's discretion.

CHANGING AN ORDER 
Changes may or may not be allowed to be made after a Commission has been accepted. These changes are allowed at the Artist's Discretion. Some changes may incur additional fees. 

 

Large changes to the design, including, but not limited to, changes in colors, species, commission type, suit type, and marking complexity, may result in the cancellation of the Commission.

PRE-MADES a.k.a READY TO WEAR FURSUITS
In purchasing a Pre-made fursuit from PAWAII, the Customer is purchasing character rights as well as the physical product, as is. Due to differences in monitors and variation caused by lighting and cameras used, the actual colors of the suit may vary slightly from how they appear online.


PAYMENT
Acceptable forms of payment include Cashier's Check, Money Order, PayPal, and Cash (US only).  PayPal is the preferred method of payment. If you'd like to pay by cash, please be aware that PAWAII is not responsible for lost or stolen mail. 


A 30%, non-refundable deposit is required for all Commission work. This amount will be required upfront or you will forfeit your Commission slot. As the Customer, you will have 48 hours from notification of Commission acceptance from PAWAII, via e-mail, to pay your deposit.


Payments made in full upfront are preferred, but PAWAII understands that this isn't always possible and we are willing to arrange payment plans with each specific customer. For Commissions, the remaining 70% of the order total is expected to be paid within the agreed upon time. For Pre-made suits, the total purchase amount is expected to be paid within the agreed upon time. 


Customers with custom orders will have 10 days from receipt of a payment invoice to pay said invoice. Customers buying a Pre-made (ready to wear fursuit) will have 48 hours from receipt of a payment invoice to pay said invoice. Any other payment arrangement must be made and agreed upon in advance. 

 

The following will apply to all payment plans arranged for custom work or pre-made work. If payments are not paid by the agreed upon deadline, late fees will be incurred. Fees will be an additional 5% of the invoice price, per day late. Customers ordering pre-made work, if payments are not paid by the agreed upon deadline, the order may be cancelled at PAWAII's discretion and you will be subject to restocking fees. 


Without notice, late payment is considered abandonment. If your Commission is abandoned and you, as the Customer, have not contacted PAWAII in a month's time, PAWAII reserves the right to charge a late fee based on the specific Commission, generally 10% of the total Commission price. If a Commission is abandoned without contact for more than 2 months PAWAII will cancel the order and is not required to refund the customer.

REFUNDS AND CANCELING ORDERS
When commissioning PAWAII, please keep in mind, the initial 30% deposit is non-refundable, regardless of circumstances.

Requesting to cancel an Commission will incur fees, depending on the length of time the contract has been active. Fees will be 5% of the total Commission price per month(s) active.


Canceling a pre-made (ready to wear fursuit) order will incur a restocking fee of 15% of the total purchase price. Customer will be refunded all but the 15% restocking fee. 


No refunds will be issued once the product has been shipped to the Customer or exchanged hands.

SHIPPING
PAWAII ships domestic and international. Unless requested otherwise, orders will be shipped via USPS. Please let PAWAII know if you have another preference. Pick up is an option on a case by case basis, but handling charges will be incurred. 


For Commissions, shipping  is not included in your Commission price. Please be aware that shipping will be charged once the fursuit has been made, approved by you (the Customer), and packed, in order to avoid under charging and over charging.  

For Pre-mades, your product will be shipped out after the product has been paid for and the shipping invoice has been paid. Unless clearly stated otherwise, the shipping price is not included in sale prices, offers, or bids.     


Any damage that occurs as a result of shipping is the responsibility of the postal service or carrier. In the case of shipping damage, the customer must contact the postal service to collect insurance. PAWAII is in no way responsible for lost, stolen, or damaged packages. PAWAII will always insure packages for the actual value.  


For international shipping, we will declare the actual value of your items. Please be aware that customs in your country may tax your package based on this value and PAWAII is not responsible for these charges. All additional charges related to shipping that are incurred are the responsibility of the Customer.

WARRANTY

PAWAII fursuits are covered under warranty for 90 days from date of shipment to Customer.  Warranty covers minor rips and tears that happen within the 90 day period.  Damage not covered by warranty includes:  water damage, misuse, negligence in the care of the suit, improper storage, or destruction of any part of the suit.  Any modification made to the suit, by the Customer or any party other than PAWAII, immediately voids all warranty.

 

PAWAII will not be responsible for suits or heads that do not fit correctly due to inaccurate measurements or Duct Tape Dummies (DTD).  However, PAWAII is available to make fit adjustments, at an additional charge, to be determined based on the adjustments needed.  The Customer will be responsible for shipping costs both directions.

 

Any suit returned to PAWAII for any reason must be washed prior to being returned.  Failure to wash the suit will result in refusal of repair work.

 

Notify PAWAII immediately if you believe your suit needs repair during the 90 day warranty period.  Notification may require photos of the damage to the suit, as well as a written description.  If the suit is eligible for repair under warranty, PAWAII will repair the suit, but the Customer pays shipping both directions.  Repairs for suits not covered under warranty may be offered at PAWAII’s discretion, but will incur a fee for the repair.

PHOTOS and VIDEOS

All photograph, videos, and other media published by PAWAII, remain PAWAII's property.  Photos, videos, or any other media of any fursuit, you may or may not own, is not allowed to be published by anyone without written permission of PAWAII.  

 

SAFETY
As a PAWAII fursuiter, you are accepting the risks of owning and wearing a fursuit. We recommend all suiters stay hydrated, suit in safe environments, and have others around to help compensate for vision and movement restrictions. We also do not recommend suiting for periods of time longer than 30 minutes without breaks. Even having followed these general guidelines, you, as the Customer and wearer, are responsible for your own health and well-being while wearing a PAWAII fursuit, as it can still pose some health risks. This is including, but not limited to, risk of falls, disorientation, dehydration, fatigue, and heat stroke. 


PAWAII is not responsible for any injury, damages, or death resulting from the use of PAWAII fursuits.

PRIVACY
All information, particularly personal information, exchanged between PAWAII and the Customer is strictly confidential. Releasing or abusing this information may result in legal action or cancellation of your order.
